Illinois Appeals Court Strikes Down Part of State’s DUI Law

An Illinois appeals court has struck down part of the state’s DUI law. The ruling found it was unconstitutional for police to have obtained blood and urine tests on a suspected drunk driver without a warrant.

The decision will mean a new trial for a man who was convicted of killing a woman and injuring her son while allegedly driving drunk in Chicago in 2009.

It’s not immediately clear how many other cases around the state could be affected, and Cook County prosecutors are considering an appeal of the decision.
